OPINION BY MR. JUSTICE EAGEN, June 28, 1969:
This is an appeal by plaintiffs from the order of the court below sustaining defendant’s preliminary objections in the nature of a demurrer to the complaint.
Plaintiffs, the Munising Terrace Owners Association (hereinafter called « Munising ») and five of its members, filed an action to recover damages on account of defendant’s alleged negligent construction of a private swimming pool on its property. The pool in question was built in 1957 by the defendant, a contractor, and was operated by the owners of the property as a private swimming facility, open to the owners and their tenants.
The complaint, in paragraphs five, six and seven, alleged that defendant was negligent in constructing the pool, in failing to provide safeguards to protect the pool from injury to the neighborhood, and in failing to take measures to correct the condition after the pool had been placed in operation for several years. Further, in paragraph eight, it was alleged that plaintiffs were damaged as a result of the defendant’s negligent construction of the pool.
Defendant, in preliminary objections in the nature of a demurrer, averred that the complaint failed to state a cause of action in negligence. The court below sustained the *61 objections and ordered the complaint dismissed. Plaintiffs appealed.
Plaintiffs contend that the allegations of their complaint are sufficient to state a cause of action in negligence and that the court below improperly sustained defendant’s preliminary objections.
